The crime of driving under the influence (DUI) is not new, but it pays to have legal representation that addresses the offense with fresh eyes. The Law Offices of James M. Chesloe in La Grange, Illinois is a firm committed to analyzing the circumstances of each case and tailoring an approach that provides the best possible outcome using up-to-date defense techniques and strategies.

Explaining DUI Consequences to Chicagoland Clients

Many DUI offenses are classified as misdemeanors, but some cases like aggravated DUI are considered felonies. A DUI means that you were operating a vehicle under the influence of alcohol and/or other drugs. A DUI conviction can result in large fines, community service, loss of driving privileges and even prison time. Having a DUI on your record is a serious matter. James M. Chesloe specializes in explaining what is at stake in DUI cases and sharing his plan to provide a skilled defense on your behalf.

According to the Illinois Vehicle Code (625 ILCS 5/11-501), a first-time DUI is classified as a Class A Misdemeanor and carries the following penalties (730 ILCS 5/5-4.5-55):

  • Up to one year in prison
  • A Maximum fine of $2,500
  • Possible suspension of Driver’s License
  • Community service

There are additional penalties if the offense involved children younger than 16. Monitoring devices may also be imposed on the offender. Such monitoring devices like the Breath Alcohol Ignition Interlock Device (BAIID) and the Secure Continuous Remote Alcohol Monitor (SCRAM) monitor the blood alcohol content (BAC) either continuously or on a random, intermittent schedule. The purpose of each device is to measure the amount of alcohol consumed by DUI offenders.

For first-time DUI offenders, James M. Chesloe can pursue court supervision and alternative sentencing. A DUI charge is not an open and shut case. Seek the help of a seasoned legal professional in the near western suburbs of Chicago, Illinois to achieve favorable outcomes for DUI matters.

Experienced Representation for Repeat and Felony DUI in Illinois

Even if you have been charged and convicted with DUI before, it is in your best interest to fight additional convictions.

According to the Illinois Vehicle Code (625 ILCS 5/11-501), penalties for a second DUI conviction:

  • Up to one year in prison
  • Mandatory minimum fine of $1,250
  • A 5-year minimum license suspension
  • Mandatory jail stay or community service

According to the Illinois State Police, a third DUI conviction is considered a Class 2 Felony and carries mandatory jail time, a ten-year minimum driver’s license suspension, up to seven years in prison and fines up to $25,000. After six violations, a DUI conviction is considered a Class X Felony.

Depending on the circumstances of a DUI felony offense, you may face extended prison time, vehicle seizure and license revocation. James M. Chesloe will work diligently to keep your driving record clean and help you get back on the road again and on your way to living a productive life.
